PRIVACY POLICY

Casting Notice · Data Subjects

1. Controller. SmartLogicCove, ul. Świdnicka 28, 50-068 Wrocław, Polska ("SmartLogicCove", "we") is the data controller for personal data processed through this website and our service engagements. Questions may be directed to [email protected].

2. What we collect. When you submit a call sheet (contact form), email us, or book a service, we collect your name, email address, telephone number, company name, project brief, and any information you voluntarily include. We also process technical data such as IP address, browser type, and pages viewed, collected via functional cookies and server logs.

3. Legal bases. We process contact data on the basis of Art. 6(1)(b) GDPR (pre-contractual measures / performance of a contract), Art. 6(1)(c) GDPR (legal obligations, e.g. tax retention), and Art. 6(1)(f) GDPR (legitimate interests in responding to inquiries and securing our website). Cookie data is processed on the basis of your consent (Art. 6(1)(a) GDPR) unless a cookie is strictly necessary.

4. Purposes & retention. Inquiry data is used solely to prepare quotes, deliver contracted automation services, and maintain business correspondence. Call-sheet and project records are retained for the duration of the engagement plus the statutory retention period required under Polish commercial and tax law (generally up to 6 years for accounting records). Marketing correspondence is retained until you object.

5. Recipients & transfers. Data is processed by vetted processors hosting systems within the European Union (email, cloud storage, payment processing via Stripe). We do not sell personal data. Where a processor requires access from outside the EEA, transfers rely on Standard Contractual Clauses and equivalent safeguards under Chapter V GDPR.

6. Your rights. Under the GDPR you have the right to access, rectification, erasure, restriction of processing, data portability, and objection to processing. You may withdraw consent at any time without affecting prior lawful processing. To exercise these rights, write to [email protected]. You also have the right to lodge a complaint with the President of the Personal Data Protection Office (UODO) in Poland or your local supervisory authority.

TERMS OF SERVICE

Screenplay · Rules of Engagement

1. Scope. These Terms govern every website visit and every statement of work (SOW) issued by SmartLogicCove for AI & automation services, including autonomous ML workflow deployment, task-oriented agent networks, cognitive data pipelines, document processing, predictive analytics, conversational assistants, process mining, and MLOps retainers.

2. Contracts. A contract is formed when both parties sign an SOW or when the client pays an issued invoice for a defined scope, whichever occurs first. The SOW — together with these Terms — constitutes the entire agreement. Conflicting purchase-order language is void unless countersigned by SmartLogicCove.

3. Fees & payment. Prices quoted in SOWs are fixed for the defined scope, exclusive of VAT where applicable. A non-refundable deposit (typically 40%) secures production slots; the balance is due on final cut delivery. Invoices are payable within 14 calendar days via the Stripe payment link or bank transfer. Late payments accrue statutory default interest under Polish law.

4. Client duties. The client supplies timely access to data sources, systems, credentials (via secure channels), and subject-matter reviewers. Delays in client feedback or data delivery extend delivery dates by an equivalent period and may trigger re-scheduling fees for reserved engineering capacity.

5. Intellectual property. Upon full payment, SmartLogicCove assigns to the client all worldwide rights in the client-specific deliverables — workflow graphs, fine-tuned model weights, pipeline code, dashboards, and documentation — excluding pre-existing frameworks, shared libraries, and tooling ("Background IP"). Background IP remains licensed to the client perpetually, non-exclusively, and royalty-free for use within the delivered solution.

6. Warranties & liability. Deliverables conform to the acceptance criteria in the SOW for 30 days after final cut; defect reports in that window are remedied at no charge. Except as expressly stated, services are provided "as is". To the maximum extent permitted by law, SmartLogicCove's aggregate liability is limited to the fees paid under the affected SOW. Neither party is liable for indirect or consequential damages. Nothing limits liability for fraud, willful misconduct, or other liability that cannot be limited under Polish law.

7. Termination. Either party may terminate an SOW for material breach not cured within 14 days of written notice. On termination, the client pays for work performed and non-cancellable commitments incurred up to the effective date. SmartLogicCove may terminate immediately where invoices are more than 30 days overdue.

8. Governing law. These Terms are governed by the laws of Poland. Disputes fall under the exclusive jurisdiction of the courts of Wrocław, without prejudice to mandatory consumer protections.

COOKIE POLICY

Continuity · Storage Notes

1. What cookies are. Cookies are small text files placed on your device when you visit this site. They allow the site to remember your actions and preferences over a period of time so you don't have to re-enter them whenever you come back.

2. Cookies we use. Strictly necessary: session and security cookies required to serve pages and protect forms against abuse. These cannot be switched off via our banner. Functional: the cookie_accepted preference stored in your browser's localStorage, which remembers that you dismissed this consent notice. Analytics: where enabled, privacy-respecting, aggregated usage statistics used to improve page structure and performance.

3. Third-party cookies. Embedded content such as the Google Maps location frame on our contact page may set cookies under Google's own policies when the map loads. Payment interactions occur on Stripe-hosted pages governed by Stripe's cookie and privacy documentation.

4. Managing cookies. You can delete or block cookies through your browser settings at any time. Blocking strictly necessary cookies may impair form submission and security features. Your consent choice is stored locally under the key cookie_accepted and can be cleared by removing site data in your browser.

5. Updates. This policy may be revised when our tooling changes. The revision date is printed in the credits header above. Continued use of the site after revisions constitutes acceptance of the updated policy where permitted by law.

REFUND POLICY

Reprint & Reshoot Terms

1. Deposits. The booking deposit secures dedicated engineering capacity on a specific production window and is non-refundable once the discovery (Script & Scout) phase has begun. If you cancel in writing before discovery starts, the deposit is refunded in full minus any Stripe processing fees already incurred.

2. Milestone payments. Fees tied to completed milestones (storyboard approval, model back-test sign-off, final cut) are non-refundable once the milestone is delivered and accepted. Work in progress is billed pro rata if an SOW is terminated for client convenience.

3. Defect remedies. If a deliverable fails its documented acceptance criteria within the 30-day warranty window, SmartLogicCove will rework the deliverable at no additional charge. If rework is not feasible and the defect is material, we will refund the portion of fees attributable to the non-conforming deliverable.

4. Retainers. Monthly MLOps retainers may be cancelled with 30 days' written notice effective at the end of the current billing month. Partial months are not pro-rated. Outstanding fees for incidents already handled remain due.

5. Statutory rights. Nothing in this policy restricts mandatory consumer rights under Polish and EU law, including statutory withdrawal rights for distance contracts where applicable to individual consumers.

6. How to request a refund. Email [email protected] with your SOW reference, invoice number, and a short description of the issue. Approved refunds are returned via the original payment method within 14 business days of approval.
